Your Price Tag Is Now Evidence

New York takes CarGurus to court over "Good Deal" badges and hidden fees while California's CARS Act tightens the screws — and shoppers are arriving payment-first, pre-briefed by a chatbot.

THE NUMBER ON THE WINDOW

New York City is suing CarGurus over more than 2,000 alleged consumer-protection violations tied to deal ratings and fees that didn't show up until later in the funnel, and California's CARS Act is pushing the same idea — the advertised price should be the price — into state law. Two different venues, one message: the gap between your listing and your buyer's order is where the exposure lives. Worth a read on both counts, because the third-party badge on your inventory is now somebody else's legal problem and, by extension, yours. If a mystery shopper priced one of your units from the listing to the contract today, you want that walk to be boring.

USED EVS KEEP SELLING

Used EV volume hit a record share of retail last month — roughly 47,862 units, up 12.3% from August and 21.2% year over year — and the supply side is tightening behind it. The demand isn't ideological; it's arithmetic, which is why cheap older Teslas and high-mile Bolts are suddenly content bait as well as lot traffic. If you're going to stock them, have the battery answer ready before the customer asks it, including what a replacement actually costs versus an engine job.

EVERYBODY SHOPS PAYMENT NOW

A new FlexPath study found super-prime shoppers asking the same two questions subprime buyers have always asked: what fits my monthly budget, and can I qualify. Meanwhile Kia is leasing the EV3 under the Bolt and Leaf, and BMW is quietly buying down payments to avoid another inventory hangover. Those subsidized new-car monthlies are the anchor your three-year-old unit gets measured against, whether or not that's fair — so lead with the payment and the term, not the sticker, or let a captive lender set your price for you.

THE ROBOT GOT THERE FIRST

Fifty-five percent of people planning to buy in the next six months say they're running the decision past ChatGPT or Gemini before they ever hit a lot, which is exactly why your inbox is full of AI SEO and "AI visibility" pitches. Brooke Furniss calls most of them a Band-Aid on a bullet hole and lays out what to make a vendor prove before you sign. Cheapest move this week: ask a chatbot about your store and your three slowest units, and see what it says back. That's your new front door, and it costs nothing to look at it.

The Morning Drive is free and always will be. The system that writes it desks the deal, prices the car, chases the stip and answers the lead — for independent dealers who are tired of paying franchise money for franchise software.
